Recent Case Highlights Need to Fight Wage Disparities Due to Gender
DALLAS–(BUSINESS WIRE)–The national law firm of Baron & Budd proudly celebrates Women’s

certification of the 19th Amendment to the United States
Constitution (August 26, 1920), which gave women the right to vote. Even
though progress in the area of women’s rights has been substantial,
Baron & Budd recently filed a lawsuit that is an example of how wage
discrepancies based on gender still exist. (In Re: Civil Action No.

On August 24, 2015, the plaintiff in the case filed a civil action
against DistributionNOW, a Houston-based supply chain solutions company
that serves a wide range of industrial markets. She filed the case
pursuant to the Equal Pay Act (EPA) of 1963, which prohibits employers
from paying employees of one sex less than the other for jobs that
require an equal amount of responsibility, effort and skill, and are
performed under similar working conditions. She is seeking twice the
amount of unpaid back wages, legal fees and other damages, claiming the
company violated the EPA.
According to the complaint, the plaintiff worked as the operations
manager at the Bridgeport, Texas business location of DistributionNOW,
replacing a man who had held that job. Despite having more years of
experience, which included training the man who held the job before her
on how to do the job, the complaint alleges that the plaintiff was
nevertheless paid several thousand dollars less per year than her male
counterpart in wages. The lawsuit also claims that, while her male
predecessor in that job was given a company vehicle and gas allowance,
she was not provided with any vehicle or gas allowance. The EPA covers
disparity not only in salary or hourly pay, but also benefits such as
car allowances, gas allowances, bonuses and numerous other forms of
compensation and benefits.
