Curt G. Joa, Inc. Files Inter Partes Review against Fameccanica Data SpA
SHEBOYGAN FALLS, Wis.–(BUSINESS WIRE)–Earlier this month Curt G. Joa, Inc. filed an inter partes review
proceeding against Fameccanica Data, SpA to invalidate a patent owned by
Fameccanica. The case, filed in the United States Patent and Trademark
Office, Patent
Trial and Appeal Board asserts invalidity of United States Patent
No. 6,994,761, entitled “Disposable Absorbent Garment such as a diaper
or training pants and a process of making the same.” This proceeding
follows another attack on Fameccanica’s European Patent (UK) no 1355604
with the same title.
In its petition, Joa alleges that other patents prior in time to United
States Patent No. 6,994,761 disclose the invention claimed in
Fameccanica’s patent: a breathable, stretchable layer assembly including
an inner material layer, an outer material layer and a stretchable
material layer disposed there between and including vent sites which are
formed by ultrasonic bonding of the inner and outer material layers
through the stretchable material layer.
